Sick leave in Spain: how much you get paid and who pays it
During sick leave (incapacidad temporal) you do not receive your salary, but a benefit calculated on your regulatory base. That base is generally your contribution base for the month before your leave divided by the days in that month.
Common illness or non-work accident
| Days of leave | Benefit | Who pays |
|---|---|---|
| 1 to 3 | Nothing | — |
| 4 to 15 | 60% of the regulatory base | Employer |
| 16 to 20 | 60% | Social Security or mutual insurer |
| From day 21 | 75% | Social Security or mutual insurer |
Work accident or occupational disease
You receive 75% of the regulatory base from the day after the leave begins. On the day of the accident, the employer pays your full salary.
Improvements in collective agreements
Many collective agreements require the employer to top up the benefit to 100% of your salary, sometimes from the first day. Check yours.
